Plano H.S. Teacher Arrested On Sexual Assault Charge

RICHARDSON (CBSDFW.COM) – A Plano high school teacher is on administrative leave after being arrested and charged with the sexual assault of a child.

A 16-year-old boy contacted Richardson police earlier this month and claimed Addison Colby Green, a teacher at Shepton High School in Plano, had sexually assaulted him.

The victim, who does not attend Shepton High, told police he had known Green for less than a year and was working at the 26-year-old’s home when the assault took place.

Richardson police began an investigation and, after DNA evidence was collected, were able to corroborate the victim’s story.

“Clearly since our suspect is 26 and our victim is 16, it’s a case where there may have been some manipulation or influence by the suspect over the victim, because of the age difference here,” explained Richardson police investigator John Wakefield.

Green was arrested and charged on November 17. He was released on a $50,000 bond one day later.

Richardson police said “there are no other known victims at this time”.

Officials with the Plano ISD said they do not believe any students in their district are involved in the issue.

The case will be filed with the Collin County District Attorneys Office.

NORTH TEXAS (CBSDFW.COM) - Police are on the lookout for a missing 5-year-old girl who is believed to be with her father and headed to Mexico.

Last Friday little Wendy Diaz visited her father, Jesus Diaz Garcia. The 32-year-old man was to return the child to her mother in Richardson, but never did.

“He was to return her to her [mother] within two days and he failed to do so and she has been unable to reach him since that time. And no one else has been able to get in touch with him either,” explained Richardson police Sgt. Kevin Perlich.

Apparently Garcia doesn’t have his own transportation and had actually borrowed a vehicle for part of his daughter’s visit. That car has since been returned and authorities don’t know how Garcia is getting around.

“He could have been on a bus, he could have been on foot, [or] he could be hitchhiking a ride,” Perlich said. “We don’t know where he’s at or how he is traveling right now.”

Police say there’s a reason a child abduction emergency bulletin hasn’t been issued.

“He [Garcia] has no criminal history indicating that he’s violent or anything like that,” said Perlich. “There’s no indication that’s been given to anyone that would think he might harm her and that’s why it did not come out as an Amber Alert.”

Jesus Diaz Garcia is wanted for Interference with Child Custody.  The little girl’s mother is the custodial parent, but there was a custody hearing scheduled for this week.

RICHARDSON (CBSDFW.COM) – A man suspected of murder and committing or attempting to commit several North Texas sexual assaults has been arrested and he was captured while allegedly carrying out other crimes.

According to Richardson police, on Wednesday the 22-year-old suspect forced his way into a woman’s apartment and held her at gunpoint. Somehow the woman was able to fight off the attacker and called police.

Police say the suspect continued his crime spree after running away from that scene.

“The suspect then fled the apartment and went to an adjoining apartment complex across the street, where he attempted to then carjack an individual,” Richardson police spokesman Sgt. Kevin Perlich explained.

The driver of the car was also able to fight off the man and escape.

Apparently undeterred, the suspect then ran into the backyard of a house on James Drive, but was soon located and taken into custody.

The suspect is believed to be responsible for a number of crimes.

“We’re gonna look at a whole bunch of different offenses that he might be involved with,” Perlich said. “Anything from other attacks, attempted carjackings, or anything else where he might fit the physical description of someone that might be responsible for hose offenses.”

Right now Richardson police think the man is the person responsible for the stabbing death of a 63-year-old father on September 7. When police found the body of victim Jimmy Wayne Donawho inside his apartment, in the 900 block of St. Paul Drive, they say it looked like Donawho had fought with his attacker.

Dallas police also want to speak with the suspect. Investigators there believe the man sexually assaulted a woman near Greenville Avenue and Martel Avenue, in Dallas’s M street neighborhood. In that case the suspect broke into a home, sexually assaulted a woman at gunpoint, hogtied her and stole some beer and a cell phone before leaving.

“We have had Dallas investigators here they have been working with us just because he fit the MO and stuff of their offense. So, we have been working together with them on this case,” Perlich said.

Richardson police have charged the suspect with one count of Burglary, one count of Robbery and one count of Criminal Trespass.

RICHARDSON (CBSDFW.COM) – It began with an emergency call about a burglary in progress and ended with a confession, and Richardson police charging three people with Capital Murder.

The confession and charges would solve three separate Richardson police cases and could close multiple sexual assault cases in Dallas.

According to Richardson police, on Wednesday a woman reported that after responding to knock at the door a man forced his way into her apartment and held her at gunpoint. The woman was able to fight off the attacker, run from the apartment and call police.

As Richardson police pursued the suspect they received information from the Dallas Police Department that the area of their disturbance was the same one where they were keeping an eye on a sexual assault suspect. That suspect was 22-year-old Jose Portillo.

Richardson continued the search for their suspect but the man wasn’t captured until after allegedly attempting to carjack a nearby driver and breaking into the house of a relative.

Once in custody the suspect was identified as Portillo.

During the attempted carjacking Portillo reportedly screamed orders while pointing a gun at the driver. After a series of events, the driver said he realized the weapon the suspect was holding was not loaded. The driver started fighting with Portillo and was able to disarm him.

When crime scene technicians took that handgun into evidence they discovered it was the same type gun stolen from the apartment of a man found stabbed to death five days earlier.

On September 7, Richardson police found the body of Jimmy Wayne Donawho inside his apartment on St. Paul Drive. The 63-year-old had been stabbed to death.

During the investigation of the murder police found fingerprints, left in blood, on Donawho’s closet door. When Portillo was arrested after his alleged crime spree on Wednesday his fingerprints were taken at the Richardson City Jail. Those fingerprints were compared to those found at the murder scene and a match was made.

Police interviewed Portillo on Thursday and it was then they say he confessed to being involved in the burglary of an apartment and the death of Donawho.

Police say Portillo told them he broke into Donawho’s apartment with two other men, Saul Montero-Mata and Omar Lima Lopez.

After taking Montero into custody he admitted knowing Portillo and to being in Donawho’s apartment in August.

After further investigation police believe the third man, Omar Lima Lopez, was a roommate of both Montero and Portillo.

All three men, who are in the country illegally, remain in custody and have been charged with Capital Murder by Terror Threat. Portillo has also been charged with Burglary and Aggravated Robbery.

Richardson police say while they questioned Portillo about events in their city he also confessed to committing the sexual assaults in Dallas. As of late Friday afternoon DPD had yet to file any formal charges.


Driver Shot Dead After Hitting Richardson Officer

RICHARDSON (CBSDFW.COM) – Police in Richardson are investigating a bizarre incident that ended with shots fired by an officer, a car crash, and a woman dead.

Everything began around 8:30 a.m. Monday as officers with the Richardson Police Department worked a traffic detail on Beltline Road.

Richardson police Sgt. Kevin Perlich explained that one woman, suspected of a traffic violation, simply would not stop. “We had an officer there that attempted to get a violator to pull off into a parking lot. That violator failed to follow the officer’s direction and continued driving past him.”

As the woman, later identified as 31-year-old Emily Krumrei, drove past, the officer took note of the car she was in and then relayed the information by police radio. An officer nearby spotted the car and tried to pull the driver over. “The violator again did not stop and happened to turn down a side street where a third officer, who was working an unrelated traffic accident, observed the motorist and attempted to stop her.”

At first it appeared as though Krumrei was finally going to comply, but Perlich said she made a move that ultimately cost her her life. “She initially slowed down as if she were gonna stop and then as she got closer she accelerated toward him and tried to get around him… making contact with him. The officer in fear for his life, fired upon that vehicle.”

Arch McKinnon witnessed the incident from his car leasing lot.  He said it was clear the woman behind the wheel didn’t want to stop for the officer.  ”He rolled to the side and shot. He gave her every opportunity to stop. I thought she was going to stop. It was that much time. But then, she just gassed it.”

“I remember looking at her going I wonder what she’s thinking, but it happened so fast,” said another witness, Iliana Davila.

The car Krumrei was driving, which police later learned was a loaner from a North Texas Lexus car dealership, continued going a short distance before crashing into a guardrail and stopping along the service road of south Central Expressway.

Krumrei, who was the only person in the car, was taken to Medical City Dallas Hospital where she was pronounced dead. She was a mother of two.

Perlich said as a matter of procedure there would be an internal investigation for, “both administrative purposes as well as criminal purposes.”

The officer who fired on Krumrei and was struck by her vehicle was not seriously injured and received no hospital treatment.

The officer has been placed on administrative leave until the investigation is complete.

Police Arrest Richardson Murder Suspect In Fort Worth

RICHARDSON (CBSDFW.COM) – Police in Richardson believe the search for a killer is over.

Investigators say they received information a possible suspect in the murder of Michael Castagne on Tuesday was at an apartment in Fort Worth. Once at the complex on the eastside of Fort Worth, officers took Daeveion Mangum into custody. He has been charged with Murder.

On Wednesday police sent out a call for help finding Castagne’s missing car, a 2013 red Kia Sportage. At that time, police felt that if they found the car they would find Castagne’s killer.

After the arrest of Mangum Thursday, Richardson Police Detective Adam Perry explained they actually received the tip in reverse. “The leads with the detectives were actually to the suspect and then we found the victim’s car in the [apartment] complex.”

It was Tuesday when a report of the smell of smoke sent firefighters to an industrial park in the 500 block of East Arapaho Road. Once there first-responders found Castagne’s body in his office.

Sources say there were no signs of forced entry at the office space leased to a company called The Brotherhood, LLC. The fire appeared to be intentionally set, possibly to try and cover-up Castagne’s murder and destroy evidence.

As it stands, police will only say that the 60-year-old businessman died from blunt force trauma. Those who knew him say Castagne was an intensely private person who spent his career in the restaurant industry and helped launch a popular Addison wine bar.

Castagne’s murder is the first one in Richardson this year.

After his arrest in Fort Worth, Daeveion Mangum, 19, was transferred to the Richardson Jail. His bond has not been set.

Richardson Police Searching For Wells Fargo Bank Robber

RICHARDSON (CBSDFW.COM) – Police in Richardson are searching for the man who robbed a Well Fargo Bank branch yesterday.

The robbery happened at a bank in the 1400 block of East Renner Road.

According to police, the man walked into the bank and handed a “demand note” to one of the tellers. After getting an undisclosed amount of cash the suspect left the bank and walked to a  nearby Whole Foods Market.

The man got into a white car that was missing the rear bumper and drove away, traveling north on Plano Road.

The suspect did not show any type of weapon during the robbery and no one was injured.

The suspect is described as a white male, in his late 40’s or early 50’s. He has short grey hair, a white goatee, and at the time of the crime was wearing a dark colored shirt, a black “construction” style jacket and blue jeans.

Anyone who recognizes the suspect or has any information about the robbery is asked to contact the Richardson Police Department at 972-744-4801.

Mom Of Richardson Toddler Found Dead Goes Before Judge

RICHARDSON (CBSDFW.COM) – More than a month after toddler Sherin Mathews disappeared in Richardson and was later found dead both of her adoptive parents are in jail. The 3-year-old’s mother, Sini Mathews, went before a judge this morning.

Sini Mathews is facing the felony charge of abandoning or endangering a child and is being held in the Richardson Jail. The 35-year-old woman was arraigned on Friday.

Mitch Nolte, one of the attorney’s representing Sini Matthews, told CBS 11 News that his client is afraid and upset, but is trying to keep it together for her surviving biological daughter.

In video seen only on CBS 11, Sini Mathews had her attorney by her side when she walked into the Richardson Police Department to turn herself in Thursday afternoon.

The abandonment charges center around investigators belief that Sini left Sherin home alone for more than an hour, while the rest of the family went to a restaurant in Garland and ate dinner.

According to a police report, a dinner receipt on the evening of Friday, October 6 showed one child’s meal was purchased and the waiter remembered only one child at the restaurant with Sini and her husband Wesley Mathews that night. The child with the couple is believed to have been the couple’s 4-year old biological daughter.

Richardson police Sergeant Kevin Perlich said the charge is, “…not necessarily related to her [Sherin’s] death. It’s related to the care she was given while in that home.”

According to a police report, Wesley Mathews said the couple left the toddler at home alone because she wasn’t drinking her milk. It was more than an hour later when he said they returned home to find her “still in the kitchen alive and well.”

When Wesley Mathews was initially arrested he told police that he was punishing Sherin for not drinking her milk and that at 3 a.m. he ordered her outside to stand by a tree about 100 feet outside their backyard. He said he left the little girl there and when he returned 15 minutes later discovered she was gone.

Wesley Mathews later changed his story claiming that he was trying to get Sherin to drink her milk, but that she wouldn’t listen to him and when she finally complied he “physically assisted her in drinking the milk.”

Mathews told investigators that the toddler began to choke and after coughing for a while her breathing slowed. He said when he could no longer feel Sherin’s pulse he “believed she had died” and removed the body from the house.

Wesley Mathews is charged with Injury to a Child and is being held on $1 million bail.

While both Wesley and Sini Mathews are behind bars investigators still do not know how their daughter died. The Dallas County Medical Examiner’s Office has yet to release an official cause of death for Sherin Mathews.


Bond Reduced For Mom Of Richardson Toddler Found Dead

DALLAS (CBSDFW.COM) – A judge in Dallas County has decided the bond for a Richardson woman, charged with child endangerment after the death of her 3-year-old adopted daughter, should be lowered.

This morning the judge lowered the bond for Sini Mathews from $250,000 to $100,000. The 35-year-old woman is currently behind bars facing the charges after her daughter Sherin Mathews was found dead.

Prosecutors fought the bond reduction and told the judge, “The facts that are contained in the affidavit show that this woman is wicked enough to leave a 3-year-old girl alone in her house while she and her husband go out to dinner. That shows the level of depravity of this woman’s heart in and of itself.”

After winning the petition to have the bond lowered Mrs. Mathews attorney, Mitchell Nolte, said, “We’re happy that the judge reduced the bond. Obviously, we’d hoped it would be a little less but it’s reasonable.”

If Sini Mathews is able to post the bond she’ll be under house arrest and required to wear an ankle monitor.

RICHARDSON, Texas (CBS11)Death at the hands of another person is the ruling from the Dallas County Medical Examiner’s Office on Sherin Mathews, the toddler whose parents are in jail in connection with her disappearance and death.

Wednesday the Dallas County Medical Examiner confirmed homicidal violence is the official cause of the death for the 3-year-old.

“That means that that person didn’t die of any type of natural causes or anything like that,” said Richardson police spokesman Sgt. Kevin Perlich. “They died at the hand of another person.”

The medical examiner’s office isn’t releasing any additional details on her death, in part because her 22-pound body was so badly decomposed after being out in the elements for two weeks, found in a culvert less than a mile from her home. Dental records were used to identify her.

Another reason more isn’t being released is law enforcement. The Richardson Police Department has challenged CBS11’s public information request for the autopsy report, which is a public record. The department says it’s trying to keep as much information private until this case goes to trial. Perlich says the autopsy will be pivotal during the trial.

“Everybody wants physical evidence,” said Perlich. “I mean that’s the stuff that’s hard to lie. It is what it is. it speaks for itself, and the more physical evidence you can get, the better.”

Wesley admitted to being in the garage with her at 3:00 a.m and “physically assisting” her in drinking the milk. He told police she stopped breathing and didn’t seek medical attention, even from his wife Sini who is a nurse.

Both Sini and Wesley Mathews, who adopted Sherin from India, are in jail now.

Wesley’s lawyer has not returned our request for comment. He is charged with felony injury to a child. Sini’s attorney repeated the mom’s claim today she was not involved in Sherin’s death. She is charged with endangering a child after police say the parents left Sherin alone at their Richardson house while the entire family went to dinner the night before she died.

Sherin parents were supposed to have a custody hearing with CPS this morning for their 4-year-old biological daughter, but the hearing was pushed back for Jan. 26 at 9:00 a.m. That child was removed from the Mathews’ home after Sherin’s disappearance.

DALLAS (CBSDFW.COM) – A Child Protective Services (CPS) hearing for custody of the biological child of Wesley and Sini Mathews is scheduled today in a Dallas County courtroom. The two are the adoptive parents of Sherin Mathews — the 3-year-old whose body was found in a culvert last year, not far from the family’s Richardson home.

The hearing centers around the parental custody of the Mathews’ 4-year-old biological daughter, who CPS removed from the family home on the same day Sherin was reported missing.

Before the hearing got underway, attorney Mitch Nolte confirmed with CBS 11 News that the couple would relinquish their parental rights to the girl and that’s exactly what happened when the hearing got underway just before 11 a.m.

The move by Wesley and Sini Mathews will eventually allow for the girl to be adopted by family members in the Houston-area who are currently her guardians. CPS spokeswoman Marissa Gonzales said, “They had to go through an extensive home study and background checks and checks on the safety of the home to make sure it was safe for the child… make sure it will be a healthy environment.”

CPS is now the permanent conservator of the Mathews biological child and their decision to relinquish their rights leaves open the possibility of them potentially having supervised visits with the child at some point.

The attorney for Sini Mathews said the couple made a “tough and difficult decision” but believe they did what they thought was in the best interest of their daughter.

Both Wesley and Sini Mathews remain behind bars accused of crimes against their adopted daughter Sherin. Mr. Mathews is charged with Injury to a Child, while Mrs. Mathews is charged with Child Endangerment.

On October 7 Wesley Mathews reported Sherin missing, saying that as punishment for not drinking her milk he sent the little girl outside at 3 a.m. to stand by a tree about 100 feet outside their backyard.

It wasn’t until two weeks later, on October 22, when the little girls body was found. After that discovery Wesley Mathews changed his story, claiming he “physically assisted the 3-year-old girl in drinking the milk” and that the toddler choked and after coughing for a while her breathing slowed.

Mr. Mathews said when he could no longer feel Sherin’s pulse he “believed she had died” and removed the little girl from the house.

Last November, during a CPS hearing for the Mathews’ biological child, a doctor testified Sherin Mathews showed signs of abuse including broken bones in various stages of healing. During a subsequent hearing a judge ruled the couple could have no contact with their biological daughter.

It was just after New Year’s Day when the Dallas County Medical Examiner listed Sherin’s official cause of death a result of “homicidal violence”.

Barricaded Gunman Shoots, Kills Richardson Police Officer & Civilian

RICHARDSON (CBSDFW.COM) – A Richardson police officer and a civilian were both shot and killed at an apartment complex in the city on Wednesday evening. The gunman, identified Thursday morning as Brandon McCall, barricaded himself inside a unit for nearly five hours.

The officer, whose name has not been released, went to the Breckinridge Point Apartments near Renner Road and North Star Road around 7 p.m. in response to a disturbance call. After being shot the 37-year-old officer was rushed to Medical City Plano but died from his injuries. It’s believed he was shot in the neck.

Police kept apartment residents inside their units as the standoff with McCall dragged on — with the man randomly firing shots throughout the evening. Ultimately McCall surrendered. Witnesses said he shouted “I’m sorry” as he was taken into custody.

Governor Greg Abbott sent his condolences to the Richardson Police Department on Twitter saying “Your loss is a loss to all law enforcement and everyone in our great state.  Texas will honor the lost officer with the dignity he deserves.”

Police departments across North Texas and the state also sent their support to the Richardson police force.

Around the same time the suspect was taken into custody police announced that the second person who was shot had died. Early Thursday morning that victim was identified as Rene Gamez. The 30-year-old reportedly lived in the apartment where the suspect held police at bay during the standoff.

The officer who lost his life is the first Richardson Police Department officer to be killed in the line of duty since the department was first organized in 1955. The flag at RPD headquarters has been lowered to half-staff.

The Guns & Hoses Foundation of North Texas has started a fund for the family of the fallen officer.

RICHARDSON, Texas (CBSDFW.COM)Police have released the name of the Richardson police officer who was killed along with a civilian on Wednesday evening. Officer David Sherrard was shot  after responding to a call about a disturbance at the Breckinridge Point Apartments, near Renner Road and North Star Road.

During a morning news conference Richardson police Chief Jimmy Spivey said when officers arrived they found the injured civilian and began rendering aid. “In the course of their investigation they were led to an apartment where they made an entry and immediately encountered gunfire.”

The Chief said Officer Sherrard fell back out of the apartment and was immediately helped by other officers.

After allegedly shooting Officer Sherrard, accused gunman Brandon De McCall barricaded himself inside one of the apartments for more than four hours. The wounded 37-year-old officer was rushed to Medical City Plano but died from his injuries. He had been shot in the neck.

De McCall, 26, is in custody facing several charges including Capital Murder of a Peace Officer.

Officials in Richardson say they have turned the investigation over to the Plano Police Department. “We have so many of our officers that were involved in this incident we felt like it would be better to let Plano handle this investigation for us,” explained Chief Spivey.

Early Thursday morning police also identified the civilian victim killed as Rene Gamez. Police say the 30-year-old lived in the apartment where McCall held police at bay and that he knew the  accused gunman. The exact relationship between the two men, if any, isn’t known.

People who knew Gamez took to social media saying their friend was “sweet” and always “the life of the party.”

The standoff kept residents sheltered in their apartments as McCall randomly firing shots throughout the evening. Ultimately McCall surrendered after officers pumped tear gas into the unit. Witnesses said he shouted “I’m sorry” as he was taken into custody.

McCall does have a criminal history. In 2016 he was arrested by Richardson police for possession of controlled substance. Last summer he was committed to a mental hospital for threatening to jump off a bridge and telling the arresting officers that he wanted to be taken to a doctor and “put to sleep permanently.”

Resident Chrystal Shaw said she sheltered inside her apartment for hours. “The gunfire was very, very loud. It seemed like he was firing about eight or nine rounds and then for about five minutes it would get quiet and then he would shoot again.”

After the shooting Governor Greg Abbott sent his condolences to the Richardson Police Department on Twitter saying “Your loss is a loss to all law enforcement and everyone in our great state.  Texas will honor the lost officer with the dignity he deserves.”

Governor Abbott will meet privately with Richardson police Chief Spivey this afternoon.

Officer Sherrard is the first Richardson police officer to be killed in the line of duty since the department was first organized in 1955.

As for how his department was coping Chief Spivey said, “It’s the hardest day we’ve ever had. We’re not doing well. But I will tell you this, this is a police department of professionals and yes it is an emotionally trying, traumatic day but they’re out there right now doing the things that they do best and serving this community. I have every confidence that policing and public safety in Richardson, Texas is going to go on just like it does every other day.”

Officer David Sherrard was a 14-year veteran with the department and was married with two daughters. A memorial for the officer has been started on a cruiser parked outside RPD headquarters and the flag there has been lowered to half-staff.

WYLIE (CBSDFW.COM) – A dedicated officer, a devoted father, and an all around great guy… that’s how people are remembering Richardson police Officer David Sherrard, who was killed in the line of duty last week.

Tributes honoring the fallen officer continue today. We’ve seen blue ribbons all across the city of Richardson, at the police department and in Officer Sherrard’s neighborhood.

Today at McMillian Junior High School in Wylie, where his daughters attend classes, students and teachers will wear blue to honor and remember Officer Sherrard and show their support for his family.

On Sunday night family, friends and total strangers came together at the Richardson Civic Center for a candlelight vigil. Hundreds braved the bitter cold to honor the 14-year department veteran, who was remembered for his funny personality and a working professionalism that left a lasting impact on his colleagues and the public he served.

Officer Sherrard’s wife and daughters were surrounded by support as fellow police officers and friends addressed the crowd.

“When a police officer or fireman dies a little bit of us goes to heaven with him… every one of us,” said retired RPD officer Morris McGowan. Sherrard’s sister, Crystal, spoke of the loss to those who loved her brother most. “I can’t think of a better husband or a better father and I know they’re going to miss him so much,” she said.

As loved ones prepare to bury a fallen hero the Richardson community is offering all the support they can. Police Chief Jim Spivey said, “We’ve lost an amazing part of our police department, a leader, the guy who picked us up. The guy who carried us.”

In addition to those in Wylie, students and staff in the Mesquite Independent School District will wear blue today. Officer Sherrard was a graduate of Mesquite High School.

RICHARDSON (CBSDFW.COM) – Family and friends will gather today to say farewell to a fallen Richardson police officer. Thousands are expected to attend the funeral for David Sherrard, which is scheduled today. The 37-year-old was shot and killed last week after responding to a disturbance call at an apartment complex.

Loved ones and fellow officers crowded First Baptist Richardson on Monday evening for Sherrard’s visitation. Today his body will be escorted to Watermark Community Church for his funeral.

A steady stream of people attended the visitation. Parents, kids, police officers from other cities, and even strangers all came together to pay their respects.

Deborah Dahl does not know the Sherrard family, but she is the widow of an Irving police officer and she said she remembers how much it meant to have support from North Texans. “I wouldn’t be here without the support of the community [and] the police,” the widow said.

Also in the crowd was Fort Worth police Officer Matt Pearce, who nearly died in the line of duty two years ago after being shot seven times. Officer Pearce said the loss of Officer Sherrard is palpable. “The family. It’s the family, they’re victims in this whole thing and we want to protect everyone we can, we really do. But when you see the family hurt, we hurt.”

Tributes have overwhelmed a police SUV set up outside Richardson Police Headquarters as a special memorial for Officer Sherrard. Everyday, for the last five days, people on their way inside have paused near the throngs of flowers, cards and balloons to acknowledge the fallen officer.

Late Monday night, police officers moved Officer Sherrard’s coffin, draped in an American flag, from First Baptist Richardson, to the Dallas campus of Watermark Community Church for the funeral today.

Officer Sherrard died serving the community and today the community will honor him. Many, if not all, of the Richardson police force will be in Dallas for the service. A number of other local police agencies will be assisting department with patrol and other duties this afternoon.

The public funeral is set to begin at 2 p.m. and a private graveside service will follow.

Officer Sherrard is the first Richardson police officer to be killed in the line of duty. He leaves behind his wife, Nicole, and his two daughters, Emily and Grace.

MCKINNEY, Texas (CBSDFW.COM) – It was two years ago this month that the Richardson Police Department lost its first officer in the line of duty. Now, the man accused of killing officer David Sherrard will stand trial.

The trial for Brandon McCall began Monday in McKinney. He faces two counts of murder, and prosecutors are seeking the death penalty.

On Feb. 7, 2018, Richardson police responded to a disturbance call at an apartment complex. However, investigators said it was an ambush.

Authorities said McCall shot and killed his friend, Rene Gamez, and then began firing on officers when they walked inside the unit.

Sherrard, 37, was shot in the neck and later died at a hospital in Plano.

The trial began with the final moments of Sherrard through graphic body camera video. The jury saw Sherrard being shot about five seconds after entering the apartment.

After a five-hour standoff, McCall surrendered. Witnesses said McCall shouted “I’m sorry!” as police took him into custody.

Sherrard was a 14-year veteran with the Richardson Police Department and was a married father of two.

During opening statements, prosecutors offered a dramatic account of the shooting, telling the jury that the officer was killed by a laser-pointed rifle and that McCall had positioned himself to ambush Sherrard and others.

Along with capital murder, McCall also faces charges of aggravated assault on a public servant for shooting at seven other Richardson officers during the incident.

McKINNEY, Texas (CBSDFW.COM) – Collin County prosecutors used a blood-stained uniform to show a jury the brutal way a Richardson Police officer died in February 2018.

They also showed the jury Brandon De McCall’s video confession during his capital murder trial.

On that video confession after his arrest, McCall is asked why he fired at officers, including Officer David Sherrard, 37, who was killed.

His answer was, “Cause I wanted to.”

Jurors also saw the murder weapon, an AR-15 rifle on Tuesday and heard from experts who brought graphic autopsy photos that had some jurors covering their mouths.

Crime scene photos from inside the Richardson apartment captured burn marks on the carpet in a back bedroom.

A crime scene investigator testified that it shows where McCall was lying in wait for officers after shooting his roommate who bled to death outside the apartment.

A gun battle and standoff lasted for two hours that night.

Defense attorneys pointed out there were dozens of boxes of unused ammo inside the apartment to try and minimize the damaging evidence against the defendant.

Later, a forensic pathologist testified one of the bullets that hit Sherrard had ricocheted off his body mounted police radio mic and entered his neck severing an artery.

“It is a fatal wound that, even if immediately treated, would have caused death,” the witness testified.

McCall confessed on video after his arrest while being treated at a Plano hospital.

The state rested its case on Tuesday evening.

The defense is expected to rest immediately on Wednesday morning and closing arguments will follow.

MCKINNEY, Texas (CBSDFW.COM) – After a two-day trial, Brandon McCall has been found guilty of capital murder in the shooting of Richardson officer David Sherrard in February 2018.

The jury’s decision came after a few hours of deliberating following closing arguments Wednesday. The defense rested its case this morning without calling any witnesses.

McCall now faces either a life sentence or the death penalty. Prosecutors were seeking the death penalty.

Police Trying To Identify 2 Richardson Home Invaders Caught On Camera

RICHARDSON (CBSDFW.COM) — Frightening moments for one North Texas woman after two men literally kicked the door of her house in over the weekend.

The home invasion/attempted burglary happened in Richardson on August 23 and was captured on security camera.

It was around 2:00 a.m. when police say the suspects ran onto the porch of the home.

Video shows one of the male suspects repeatedly kicking the front door, trying to break the lock. After kicking the door more than half a dozen times, the suspect then tries to break the door down with his shoulder. His actions were successful and in less than 30 seconds the door, and its entire frame, crashed inward.

But as the suspects rushed inside the house a woman can be heard screaming. Her shrieks send the pair running… they jump over the broken door and run out into the dark, without taking anything. Police believe the home invaders did not expect anyone to be home.

By the time officers arrived they couldn’t find the suspects.

At the time of the offense one of the suspects — the one who broke down the door — was wearing a long-sleeved red shirt, white pants and red and white sneakers. He also had a tan cap on and appeared to be wearing blue rubber gloves.

The second suspect had on a short-sleeved black t-shirt, with a lighter colored long-sleeve shirt underneath. He also wore blue rubber gloves and had on a white cap and multi-colored pants. Both suspects were wearing face coverings.

The incident is under investigation and police are asking anyone who recognizes the suspects or has information about the crime to contact Richardson police at 972-744-4800.

Richardson Police Investigate Suspected Murder-Suicide That Left Man And Woman Dead

RICHARDSON (CBSDFW.COM) — A suspected murder-suicide is being investigated by police in Richardson.

Officers found a man and woman dead inside a house in the 2100 block of Sunrise Trail in the early morning hours on December 15.

A family member had called 911 after going to the house to check on the woman’s welfare and find the two dead.

Police say the woman had been shot and the man died of an apparent self-inflicted gunshot wound. Both the victim and suspect had a previous relationship and lived at the house.

The names of the victims have not been released, pending notification of family.

Richardson detectives say they are continuing with the investigation and ask that anyone with information about the deaths contact the department at 972-744-4800.

RICHARDSON, Texas (CBSDFW.COM) – After more than 26 years of service with the Richardson Police Department, Police Chief Jim Spivey has announced plans to retire on May 31.

Chief Spivey’s retirement month will coincide with his 50th year of policing.

“I have been honored to serve the citizens of Richardson with this great organization of men and women dedicated to public safety” said Spivey. “I am proud of the work we have accomplished during my service and I take comfort knowing that the great work done by the department is going to continue well into the future.”

Spivey came to Richardson after serving almost 25 years with the Dallas Police Department.

He began his career with Richardson in 1995 when he was hired as a Captain and was appointed Richardson Chief of Police in August 2009, the city of Richardson said in a news release Tuesday, March 9.

“Chief Spivey has been an integral part of our public safety efforts in Richardson and we have much to thank him for as he transitions out of public service,” Richardson City Manager Dan Johnson said. “I look forward to celebrating his accomplishments between now and his retirement.”

City Manager Dan Johnson will establish a replacement selection process in the coming weeks regarding the timely filling of the position.


Assistant Chief Of Police Operations Gary Tittle New Top Cop In Richardson

RICHARDSON, Texas (CBSDFW.COM) – With 33 years of experience in law enforcement, Assistant Chief of Police Operations Bureau Gary Tittle will now serve as the next chief of the Richardson Police Department.

He will ascend into the top position next month upon the retirement of current Richardson Police Chief Jim Spivey.

“We are very fortunate to have Gary in our ranks to elevate to this important position,” said Richardson City Manager Dan Johnson. “The role of chief of police requires a tenured professional who knows all aspects of law enforcement. That includes experience working the streets, working with the community, and working through the legislative process at the local and state level. Those are rare attributes to find in one individual, and Gary is a seasoned professional who brings all of that with him – and so much more.”

Tittle started as a captain over the department’s Technical Services Division and was promoted to various positions within the department, being promoted to his current position in March of last year.

Prior to serving with the Richardson Police Department, Tittle started his career with the Dallas Police Department in 1987 as a patrol officer. He served more than 30 years with there, progressing through the ranks, attaining the title of assistant chief at the height of his career there. During his time in Dallas, Tittle gained law enforcement experience and accolades serving in multiple areas including work as a patrol officer, detective, supervisor over internal affairs and public integrity divisions, held various appointments to community boards and served as a liaison with state legislators.

“Serving as chief of police is an enormous responsibility and duty that I am honored to have,” said Tittle. “I very much appreciate this opportunity to expand my decades of experience and ability to work with the people who serve in the department, and I look forward to continuing to build the community connections we have cultivated to enhance our reputation as having a ‘higher caliber’ to the people we serve.”

Tittle holds a Master of Science in Criminal Justice and Leadership Management from Sam Houston State University and graduated magna cum laude with a Bachelor of Applied Arts and Sciences from Midwestern State University. He has also completed executive training from the Senior Management Institute for Police, Federal Bureau of Investigations National Academy, and Caruth Police Institute.

Current Richardson Police Chief Jim Spivey announced his retirement to take place at the end of this month, the 50th anniversary of his career in police service. Tittle’s appointment as the new chief will begin June 1.

Richardson Police Officer Accuses Department Of Illegal Quotas To Write Tickets

RICHARDSON, Texas (CBSDFW.COM) – For 13 years, Officer Kayla Walker has called the Richardson Police Department her work home.

And for that entire time, she says she’s been compelled to write tickets.

“The Richardson Police Department has been illegally using quotas to evaluate and discipline patrol officers for not writing enough tickets, arresting enough people, or making enough citizen arrests,” she told Richardson City Council last month.

Walker said it’s done under the guise of monthly productivity reports to compare officers to one another.

She said the threats include schedule changes, which could potentially limit her parenting time.

“I’m literally faced with a choice of violating state law or limiting my time with my child. No parent should ever have to make that choice,” she said.

Kevin Lawrence, the Executive Director of the Texas Municipal Police Association, said ticket quotas are illegal for good reason.

“You wind up with less confidence in your local law enforcement agency, you deteriorate the relationship between your citizens and your police department,” he said.

But he said he’ll be surprised if this case reaches the level of illegal quota.

“Measuring productivity is okay. It becomes a violation when they’re attempted to increase revenues by writing a bunch of tickets,” he said.

Richardson’s City Manager said the matter is under thorough review, saying, “This review will involve outside legal counsel and will be conducted in an orderly and expeditious way. At the conclusion, I will make a public understanding of that outcome.”

A city spokesperson said there’s no time frame as to how long the investigation will take. The city manager is asking for patience and understanding throughout that process.
